In the meeting of State Secretaries on September 15, 2011, it was announced that a draft law of “Industrial Property Law” is introduced that will significantly change a number of issues in the field of industrial property. When the new law comes into force, the status of the Patent Office will change from administration authority under direct control of the Ministry of Justice to a state agency under subordination of the Ministry of Justice, determining functions and general procedures of the Patent Office. Regulation of activities of the Board of Appeals of the Patent Office (hereinafter – Board of Appeals) will be changed. The law will prescribe reorganization of disputes review instance - Board of Appeals, namely, not creating a new institution, it provides functional independence of the Board of Appeals. It will precisely regulate representation of persons before the Patent Office and the Board of Appeals as well as eliminate deficiencies of legal regulation of the professional patent attorneys.
