New redaction of Nice Classification
The Nice Classification (NCL) is an international classification of goods and services applied for the registration of trademarks and service marks. It was established by an Agreement concluded at Diplomatic Conference held in Nice in 1957: the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks. New 10th edition of the Nice Classification comes into force on January 1, 2012.

On November 22-24, 2011 trainings for customs officers, authorities of other institutions of the State Revenue Service and invited officers from the State Police of the respective region were held in Liepaja, Riga and Daugavpils. During the seminars a number of experts of various trademark owners as well as other specialists in intellectual property matters gave their presentations.

RAFFAELLO vs. RAFAEL (Latvia)
On 17 November 2011 the Regional Court of Riga adopted a decision in civil case between Belgian company “Soremartec S.A.” vs Latvian company “O’Lana” about infringement of the well-known trademarks RAFFAELLO using a name RAFAEL on cakes. The Agency TRIA ROBIT represented interests of the company “Soremartec S.A.” in this case.

In the meeting of State Secretaries on October 10, 2011 three new draft laws were pronounced in the field of industrial property - “Law on Trademarks and Indications of Geographical Origin”, “Law on Industrial Designs” and “Patent Law”. The aim of these draft laws is to prevent contradictions in the “Industrial Property Law”

On 6 October 2011 Cancellation Division of OHIM adopted a decision in case between Cello Plastic Industrial Works (IN) vs Cello Europe Ltd. (UK) about invalidation of Community trademark CELLO (5068176).

New Law is announced
In the meeting of State Secretaries on September 15, 2011, it was announced that a draft law of “Industrial Property Law” is introduced that will significantly change a number of issues in the field of industrial property.
A separate specialized court to resolve disputes relating to intellectual property rights may be established in Russia in 2012. The draft of the respective bill is already developed and submitted to the Parliament.

Amendments in the customs law
Cabinet of Ministers of the Republic of Latvia has passed a new Regulations under No. 112, which introduced new rules for applying Customs control measures for protection of intellectual property rights.

Kazakhstan joined the Madrid Protocol
Kazakhstan joined the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks. The Madrid Protocol entered into force concerning the Republic of Kazakhstan on 8 December 2010.
