Relevant information in the field of fighting against counterfeit goods
A year ago Regulations of the Cabinet of Ministers No.112 “Procedures for the Taking of Customs Control Measures for the Protection of Intellectual Property Rights” (adopted on February 8, 2011) came into force, replacing Regulations of the Cabinet of Ministers Nr.749 “Procedures for the Taking of Customs Control Measures for the Protection of Intellectual Property Rights” (adopted on October 4, 2005).

A law establishing a specialized court for intellectual property rights is passed in Russia
The Federal Constitutional Law 06 December 2011 "On Amendments to the Federal Constitutional Law “On Judicial System of the Russian Federation” and the Federal Constitutional Law “On arbitration courts in Russian Federation" in connection with the creation of system of arbitration courts of the Court of intellectual property rights" entered into force on December 8, 2011.

New redaction of Nice Classification
The Nice Classification (NCL) is an international classification of goods and services applied for the registration of trademarks and service marks. It was established by an Agreement concluded at Diplomatic Conference held in Nice in 1957: the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks. New 10th edition of the Nice Classification comes into force on January 1, 2012.

RAFFAELLO vs. RAFAEL (Latvia)
On 17 November 2011 the Regional Court of Riga adopted a decision in civil case between Belgian company “Soremartec S.A.” vs Latvian company “O’Lana” about infringement of the well-known trademarks RAFFAELLO using a name RAFAEL on cakes. The Agency TRIA ROBIT represented interests of the company “Soremartec S.A.” in this case.

The new court to resolve disputes on intellectual law
A separate specialized court to resolve disputes relating to intellectual property rights may be established in Russia in 2012. The draft of the respective bill is already developed and submitted to the Parliament.
